LISTEN® SA is a market research agency which arranges and undertakes surveys on behalf of various advertisers who wish to improve their knowledge of the market.

In this capacity, respecting the privacy of the people we survey is of paramount importance to us.

Protection of privacy

LISTEN® SA processes your data in compliance with all the legal provisions, in particular the Act of 8 December 1992 on the protection of privacy in relation to the processing of personal data (hereafter the “Privacy Act”).

By making use of our services (in particular by responding to one of our questionnaires), you explicitly agree to this “Privacy Policy” and to your data being processed in accordance with the Privacy Act and this Privacy Policy.

LISTEN® SA uses mailing lists provided to it by its advertising clients, who are responsible for data processing. As a subcontractor pursuant to the Privacy Act, LISTEN® SA acts solely on the instructions of its clients.

Data collection

Our surveys may be conducted through various channels (telephone, post, e-mail etc.)

The responses are recorded anonymously in our data file, with a few exceptions. In this case, we will explicitly inform you and request your prior authorisation.

Once we have anonymised your data, it is impossible to identify which responses to our questionnaire were given by which respondent. This anonymisation is irreversible.

You are never under any obligation to participate in a survey. Likewise, you are never under any obligation to answer all the questions in the survey.

Use of the data

Anonymised data:

Your data may be used for the following purposes:

  • For research and analysis purposes, particularly when questionnaires are involved
  • To create collective profiles (never on an individual basis)

Non-anonymised personal data:

Your data may be used for the following purposes:

  • For research and analysis purposes, particularly when questionnaires are involved
  • In order to select a competition winner
  • In order to share your data with our clients for direct marketing purposes
  • In order to create profiles or segment your data on our clients’ behalf

We will always request your authorisation before processing your data in a non-anonymised manner.

Right of access, correction and deletion of your data

You may access the data we hold about you at any time, on provision of proof of your identity.

If the data we hold about you are incorrect, you may also ask us to correct them.

You may also object at any time – free of charge and without giving reasons – to the use of your data for direct marketing purposes

If the information you have sent us has been anonymised, we will of course no longer be able to share it with you.

 Ownership of data and data transfer

 LISTEN® SA processes your data in the capacity of a subcontractor, acting on the instructions of its end clients. We therefore do not own the data collected, whether or not those data are anonymised.

As a general rule, we only share anonymised data with our end clients. If, by way of exception, we are not anonymising your responses, we will seek your prior authorisation to proceed with processing your responses.

We may also share your data with our own subcontractors (such as the server manager, the call centre that telephones you etc.). In this case, we will take all the necessary steps to ensure the security of your data and the subcontractors involved will never become the owners of your data.

Security

LISTEN® SA undertakes to implement the necessary technical and/or organisational measures to limit access to your personal data to persons who need the data in order to perform their duties and who will use them for that purpose alone.

LISTEN® SA undertakes to implement the required technical and organisational measures to protect your personal data against accidental or unauthorised destruction, against accidental loss and against editing, access or any other unauthorised processing.
